1. Introduction

The purpose of this Privacy Policy is to inform you about how LP HOTELES S.A. with RUC 20606790890 and domiciled at Jr. Mariscal La Mar N°991 - 7th Floor, Magdalena del Mar, Lima; carries out the processing of Personal Data that it collects independently through the different electronic forms available on the website, applications and other electronic environments available to LP HOTELES S.A., including the consents granted by telephone or other forms of communication in which refer to this Privacy Policy.

2. Objetive and Purpose

At LP HOTELES S.A. we are aware of the high regard for the privacy of our guests, booking customers and of all those people who are interested in our products and services (hereinafter "Users"). Being consistent with this consideration, we are committed to respecting your privacy and protecting the confidentiality of your private information and personal data. And that is why the objective of this privacy policy is to make our Users aware of the way in which personal data is collected, processed and protected, defined according to Law No. 29733 Personal Data Protection Law. The purpose of the website is to publicize the products and/or services marketed by LP HOTELES S.A., manage the contracting of services and/or products marketed by LP HOTELES S.A. and provide information about the services and/or products that LP HOTELES S.A. sells, as well as provide other types of information that we believe may be of interest and create a communication space for Users.

3. Legislation

This policy is regulated by Peruvian Legislation and in particular by: Law No. 29733 - Personal Data Protection Law. Supreme Decree No. 003-2013-JUS, which approves the Regulations of Law No. 29733. Information Security Directive, approved by Directorial Resolution No. 019-2013-JUS/DGPDP

4. Authorized use of personal data

In order to provide products and services, LP HOTELES S.A. informs Users that, under current regulations (Law No. 29733 and its regulations), it is authorized to process personal data provided physically or digitally by the User or to which LP HOTELES S.A. legitimately accesses your personal information. This includes personal data provided in the future by Users, or those generated by LP HOTELES S.A. under the provision of services. In this sense, LP HOTELES S.A. requires the free, prior, express, unequivocal and informed consent of the owner of the personal data for the treatment thereof, except in exceptional cases expressly established by Law. Therefore, LP HOTELES S.A. does not require consent to process User information obtained from sources accessible to the public, free or not; Likewise, you may use your personal data from non-public sources, provided that said sources have the User's consent to process and transfer such personal data. The User undertakes to keep his information permanently updated during his relationship with LP HOTELES S.A., for the correct execution of the services. In some cases, the personal data collected by LP HOTELES S.A. is mandatory; consequently, the refusal to supply them could make it impossible to achieve the purposes set forth in this Policy. I declare that I am informed that the authorization provided will last as long as my contractual, commercial and/or any kind of relationship with LP HOTELES S.A. remains in force and for up to ten (10) years after its termination. In this case, my Personal Data will be stored in the database of LP HOTELES S.A., registered in the National Registry for the Protection of Personal Data under the name "Guests". In the event that the User makes a reservation for accommodation services with LP HOTELES S.A., the authorization provided will last for up to ten (10) years from when I gave my consent. In this case, my Personal Data will be stored in the LP HOTELES S.A. database, registered in the National Registry for the Protection of Personal Data under the name “Reserve Customers”.

5. Purpose of the processing of personal information

LP HOTELES S.A. will treat the information provided by the User in order to execute any contractual, commercial and/or relationship of any kind, that it maintains and/or will maintain with the User, to collect the personal data of the guests, obtained through the e-commerce, web platforms and at the hotel reception, so that accommodation services can be provided, attend customer communications, carry out loyalty activities, as well as for statistical and/or analytical purposes, and/or customer behavior and / or to evaluate the quality of the service provided.
For the development of the purposes mentioned in the previous paragraph, LP HOTELES S.A. may transfer your personal data to providers nationwide such as: Los Portales SA, by virtue of a management contract with LP HOTELES S.A., through which it provides you with an evaluation and monitoring compliance with personal data protection regulations; and international providers such as: Microsoft Azure (United States) for the cloud storage service provided by Azure; subjecting all of these to the same obligations and security, technical and legal measures described in the Law and the Regulations.
In the event that the User makes a reservation for accommodation services with LP HOTELES S.A., the Personal Data of the Users will be processed in order to collect the personal data of the reservation clients, obtained through electronic commerce and on web platforms, to deal with room reservations, perform customer service, perform commercial management, as well as for statistical and/or analytical purposes to assess the quality of the service provided.
For the development of the purposes mentioned in the previous paragraph, LP HOTELES S.A. may transfer your personal data to providers nationwide such as: Los Portales SA, by virtue of a management contract with LP HOTELES S.A., through which it provides you with an evaluation and monitoring compliance with personal data protection regulations ; and international providers such as: Microsoft Azure (United States) for the cloud storage service provided by Azure; subjecting all of these to the same obligations and security, technical and legal measures described in the Law and the Regulations.
LP HOTELES S.A. makes available to the User digital channels and call centers for the attention of queries. Through these channels we collect the necessary personal data from the User in order to support, supervise and improve User support processes, investigate, manage and resolve queries and doubts, in accordance with current applicable regulations and the provisions of regulatory bodies, government entities and official investigations. Similarly, the information may be transferred to the authorities or third parties authorized by law under current national and/or international regulations (including Law No. 29733, its regulations and those that modify or replace them, as well as those linked to the authorities that oversee the work of LP HOTELES S.A.).

6. Optional purposes(requires express consent)

Optionally, your personal data may be used by LP HOTELES S.A. for the following purposes:
- Offer of products or services and promotions by LP HOTELES S.A.
- Offer of products or services and promotions by the following companies nationwide: Los Portales S.A., Los Portales Estacionamientos Operadora S.A., Los Portales Estacionamientos S.A., Concesión Estacionamientos Miraflores S.A., Inversiones Costa Norte S.A., Los Portales Departamentos S.A.C.
The User may at any time revoke the expressly granted consent.

7. Exercise of the rights of access, rectification, cancellation and opposition of datas

Users may direct their request to exercise their rights in the terms established by the Regulation of Law No. 29733, by sending us an email to the following address: derechosarcounh@losportales.com.pe, with the reference: "Data Protection”, attached the following documents:

  1. a) ARCO Rights application, duly completed and signed. You can download the format here
  2. b) Simple and legible copy of your National Identity Document.
  3. c) In case of acting through a representative, attach a Power of Attorney with a notarized legalized signature not older than 30 days and a copy of the representative's National Identity Document.
  4. d) Others, if you consider it necessary to add more information to support your request.
8. Video surveillance

LP HOTELES S.A. It has a video surveillance system in its facilities nationwide, for their safety. The administration of our video surveillance system complies with the personal data protection regulations and is governed by the provisions of this Policy, insofar as they are applicable to it. Likewise, LP HOTELES S.A. has adopted the levels of security and protection of personal data legally required, and has installed all the means and technical measures at its disposal. The information captured through our video surveillance systems will be kept for a period of 30 days and will be managed in the LP HOTELES S.A. database, registered in the National Registry for the Protection of Personal Data under the name “Video Surveillance”.

9. Validity and modification of this privacy policy

The LP HOTELES S.A. Web Privacy Policy has been updated on 14 from august to 2023. LP HOTELES S.A. reserves the right to modify its Web Privacy Policy in the event that there is a change in current legislation, doctrinal, jurisprudential or due to its own business criteria.
